When do terms of service apply although OpenCode is MIT-licensed? #6285

Question

First, thank you for this great product!
https://opencode.ai/legal/terms-of-service seems to apply not only for use of OpenCode Zen, although OpenCode is MIT licensed. If I just clone the OpenCode repo from GitHub, I have not accepted these terms, right? So under which conditions do they apply? I‘d expect them to only apply to usage of OpenCode Zen and not to the use of OpenCode itself, as it is MIT licensed, but that doesn‘t seem to be the case.
